OGS-6 now has a source code license!

Dear OGS-developers,

from now on the source code on the OGS-6 repository has a software license. The license text is the following:

Copyright (c) 2012, OpenGeoSys Community ([http://www.opengeosys.net](http://www.opengeosys.net))

All rights reserved.

Redistribution and use in source and binary forms, with or without

documentation and/or other materials provided with the distribution.

3. All advertising materials mentioning features or use of this software

must display the following acknowledgement:

4. Neither the name of the OpenGeoSys Community nor the

names of its contributors may be used to endorse or promote products

5. Attribute the OpenGeoSys Community, preferably citing an appropriate

paper listed on the OpenGeoSys Community homepage:

ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT

(INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS

SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

This is a modified 4-clause BSD license with the fifth point added by us. This will greatly help us to justify the name OPEN-GeoSys. Hopefully the mentioned new OGS homepage will be up and running in the near future.

Hi all,

Lars, Thank you for the first proposal about license. We definitely need a license to make ogs6 "true" open-source.

After reading it, I have some questions about it. Please correct me if I'm wrong.

1. Does "OpenGeoSys Community" legally exist?
2. Has UFZ accepted that the copyright of OGS goes to "OpenGeoSys Community"? I thought OGS naturally belongs to UFZ since OGS is mainly developed using UFZ resource.
3. If LGPL version of QT is used, a binary of OGS-GUI doesn't really follow BSD license anymore. Isn't it necessary to mention this in the license or somewhere else?
4. Why not add one more point saying that, if you modify OGS and want to distribute it, you must disclose the modified source codes. I want to ask people give us feedback.
5. How about copyright of each source file? I think we need to accept individual copyright, e.g. Kiel, PSI.

Best regards,
Norihiro

Hi there,

1. Does "OpenGeoSys Community" legally exist?

No, we are currently checking with our legal department if that is a valid statement or if we need to found an association or something.

2. Has UFZ accepted that the copyright of OGS goes to "OpenGeoSys Community"? I thought OGS naturally belongs to UFZ since OGS is mainly developed using UFZ resource.

According to Olaf that seems to be okay. We should make sure, tho.

3. If LGPL version of QT is used, a binary of OGS-GUI doesn't really follow BSD license anymore. Isn't it necessary to mention this in the license or somewhere else?

Good point, we will check this!

4. Why not add one more point saying that, if you modify OGS and want to distribute it, you must disclose the modified source codes. I want to ask people give us feedback.

We feel that as long as people acknowledge us as source this isn't really necessary. However, I would think it highly unlikely that people would not disclose the code to you if you asked them to.
Also, in reality you cannot enforce such a thing and simply need to have faith that people are honest...

5. How about copyright of each source file? I think we need to accept individual copyright, e.g. Kiel, PSI.

We doubt that this would work in reality as most files are edited by multiple people (e.g. is there anyone who hasn't at some point worked on rf_bc_new.cpp??)

Hi again,

3. If LGPL version of QT is used, a binary of OGS-GUI doesn't really follow BSD license anymore. Isn't it necessary to mention this in the license or somewhere else?

It seems that as long as you don't modify the code of a LGPL-licensed library and use dynamic link, you simply need to mention that you are using said library and mention their license. (This would even work for closed source projects.)

If you modify the code things get difficult ... but we don't want to do this.

Best,
Karsten

Hi all,
I do not think I will claim individual copyright on files.
Instead we will contribute with the GEMS kernel source code (first for OGS 5). The code will be probably published under LGPL or similar.
Greetings, Georg
